When the Household Fails: Abeyance and Vacant Successions from Institutional Guardianship to Local Belonging (Europe and the Ottoman World) <\/em>(20th January 2017, CRH, EHESS, Paris)<\/strong><\/h2>\n\n\n\n

The study of the strategies used by family institutions to ensure the continuity and survival of the lineage name, estate, memory of ancestors and so on is both a social history and anthropology topos. Such strategies have been analysed primarily from a perspective that could be defined \u2018internal\u2019 to what a long tradition of study considers full blown corporate households. What are being analysed are, in fact, the resources and tactics adopted by the \u2018representatives\/administrators\u2019 of these corporations (marriage exchanges and alliances, wills and donations, entail\/majorat or chapel benefices, etc.) for the ultimate purpose of ensuring the corporation\u2019s survival together with the appointment, each generation, of reliable corporation representatives\/administrators.<\/p>\n\n\n\n

Less attention has been paid to the crisis and the failure of such reproduction strategies. When a household representative\/administrator was temporarily or permanently lacking (whether because of temporary absence, incapacity, criminal failure or because no appointment had been made) whose duty was it to take on the financial, social, religious and other obligations expected of individual members and the domestic institution as a whole? Whose duty was it to protect far off absent heirs, incapable of taking up their inheritance, deal with creditors and carry out all third party obligations? Whose duty was it to look after rights to material assets or the souls of the dead \u2013 considered legal entities themselves \u2013 for example by collecting real estate dues, paying religious and pro anima<\/em> legacies for ancestors and also ensuring that the patrimonium<\/em> did not deteriorate or was not taken over illegally? Lastly, whose duty was it to safeguard the community against the negative effects deriving from the inability of the corporate households to do their duties (i.e. paying duties, taking part in maintaining local resources and ceremonial duties, maintaining borders between those who belonged to the community and those who did not, etc.)?<\/p>\n\n\n\n

In a soci\u00e9t\u00e9 a maisons<\/em> interest in perpetuating corporate households went beyond the family institutions themselves. Such bodies actually performed a fundamentally important role in the constitutional and socio-political order of the res publica<\/em> and were the base unit in social and economic reproduction.<\/p>\n\n\n\n

Faced with ongoing risk of crisis and extinction of households, then, both sovereign and community institutions as well as the economic system as a whole developed legal, social and institutional devices whose purpose was to sustain the financial and constitutional viability of family institutions including, in the last resort, taking on the responsibilities of the corporate households and substituting them when they were not capable of fulfilling (or attempted fraudulently to get out of) their primary duties to guarantee ad infinitum<\/em> a representative\/administrator capable of carrying out the body\u2019s responsibilities. To use a modern parallel, it could be said that when a corporation\u2019s pro tempore<\/em> administrator was absent, the community, religious or sovereign institutions developed administration methods to safeguard such duties with a sort of bankruptcy receiver in order to manage and honour its third party obligations. The entire social order would, in fact, have been undermined if trust in the solidity of the family institutions as a nucleus of social production and reproduction had ceased to exist. These safeguard devices, moreover, were always twofold in value. On one hand they were social control mechanisms and devices by which the upper lay and ecclesiastical echelons intervened in the internal dynamics of bodies; on the other they provided precious tools to the latter in laying claim to rights and responding to the risk of failure.<\/p>\n\n\n\n

This study day proposes to analyse these safeguard mechanism and the institutions set up to deal with the issue of the failure of domestic institutions, focusing attention on the intergenerational transmission of assets, rights and obligations. In particular the proposed focus of attention is the management of so-called abeyance (what civil law calls hereditas iances<\/em>, literally \u2018lying inheritance\u2019, i.e. estates which remain temporarily without an owner in expectation that the legitimate heir claimed his rights) and vacant successions (what civil law calls bona vacantia<\/em>, \u2018stray goods\u2019, estates with no owner as a result of the extinction of the inheritance succession). The above mentioned mechanisms, which description draws on the Iberian and Latin contexts, do not appear to be specific to these geo-historical spaces. The fundamental hypothesis to be debated is that various societies in different time frames and geographical areas have had to face up to what was a shared problem: ensuring that no patrimony should remain without an owner for the purposes of guaranteeing the performance of reciprocal obligations and safeguarding social and economic relations (for example debt and credit payments both worldly and otherworldly, both material and symbolic and the fulfilment of fiscal and ceremonial duties, etc.).<\/p>\n\n\n\n

Debate is thus proposed around certain general themes capable of generating comparative analysis. A by no means complete series of issues could be summarised as follows.<\/p>\n\n\n\n

Firstly, who did the assets which were left heirless belong to, those which, in the Roman legal lexicon were referred to as \u2018vacant\u2019 assets? In other words, who was the default and last instance heir to these assets? Whose job was it to act as will executor for families at risk of extinction or which had died out? Which institutions acted for such subjects and how were temporarily \u2018lying\u2019 assets, such as abeyant estates for example, administered? What role was played by the Early Modern era colonial dominions in creating new institutions and modifying those of medieval origin?<\/p>\n\n\n\n

Secondly, how were the rights of absent or incapable heirs to be safeguarded for the purposes of preserving social bonds? Which institutions and safeguarding institutions were employed by the ruling bodies to protect such rights and estates? How were legitimate heirs identified and how was information on them gathered? What devices and institutions could absent heirs access to safeguard uncertain rights and assets? How were the rights of subjects which were by nature \u2018immaterial\u2019 (the souls of the dead, religious legacies, etc.) and thus required the perpetual appointment of a \u2018material\u2019 administrator or guardian safeguarded?<\/p>\n\n\n\n

Thirdly, what techniques were adopted for the purposes of legitimising such appropriations? What use was made of vacant assets when they passed into the hands of sovereign or community bodies? What role did such assets and practices play in the creation and perpetuation of local and supra-local networks? How were household obligations towards bodies linked to them by joint responsibility mechanisms, and towards society as a whole, redistributed and managed?<\/p>\n\n\n\n

L\u2019\u00e9tude des strat\u00e9gies utilis\u00e9es par les institutions familiales pour assurer la continuit\u00e9 et la p\u00e9rennit\u00e9 du nom de la maison, de son patrimoine, de la m\u00e9moire des d\u00e9funts, etc. est un des topos de l\u2019histoire sociale comme de l\u2019anthropologie. De telles strat\u00e9gies ont \u00e9t\u00e9 tout d\u2019abord analys\u00e9es dans une perspective pour ainsi dire \u00ab interne \u00bb \u00e0 celles qu\u2019une longue tradition d\u2019\u00e9tude consid\u00e8re comme de r\u00e9elles et v\u00e9ritables \u00ab corporations familiales \u00bb. Sont en effet analys\u00e9es les ressources et les tactiques adopt\u00e9es par les \u00ab repr\u00e9sentants \/ administrateurs \u00bb de ces corporations (\u00e9changes et alliances matrimoniales, testaments et donations, fondations de fid\u00e9icommis \/ majorat ou de chapellenie) pour parvenir \u00e0 garantir la perp\u00e9tuation de la corporation, ainsi que la nomination, de g\u00e9n\u00e9ration en g\u00e9n\u00e9ration, d\u2019un digne \u00ab repr\u00e9sentant \/ administrateur \u00bb  du corps.<\/em><\/p>\n\n\n\n

Le moment de la crise et de l\u2019\u00e9chec de telles strat\u00e9gies de reproduction a fait l\u2019objet en revanche d\u2019une moindre attention. Quand la maison se trouve priv\u00e9e, temporairement ou de fa\u00e7on permanente, de \u00ab repr\u00e9sentant \/ administrateur \u00bb (soit parce que temporairement absent, incapable ou frauduleusement d\u00e9faillant soit parce qu\u2019inexistant) \u00e0 qui revient la charge des obligations \u00e9conomiques, sociales, religieuses, etc., qui rel\u00e8vent des membres du corps et de l\u2019institution domestique dans son ensemble ? A qui incombe la protection des lointains h\u00e9ritiers absents qui ne sont pas en mesure de r\u00e9clamer l\u2019h\u00e9ritage, tout comme les cr\u00e9anciers et toutes les obligations envers des tiers ? A qui revient de s\u2019occuper des droits des biens mat\u00e9riels ou des \u00e2mes des d\u00e9funts, consid\u00e9r\u00e9es elles-m\u00eames comme des entit\u00e9s juridiques (encaissant par exemple les rentes immobili\u00e8res, payant pour les legs pieux ou en m\u00e9moire des a\u00efeux, mais s\u2019assurant aussi que le patrimonium ne d\u00e9p\u00e9risse pas et ne soit pas ind\u00fbment d\u00e9tourn\u00e9) ? A qui revient enfin de prot\u00e9ger les communaut\u00e9s contre les effets pervers li\u00e9s \u00e0 l\u2019incapacit\u00e9 des corporations familiales \u00e0 assumer leurs propres devoirs (par exemple le paiement des imp\u00f4ts, les participations \u00e0 l\u2019entretien des ressources locales et \u00e0 la vie c\u00e9r\u00e9monielle, le maintien des fronti\u00e8res entre membres et non membres de la communaut\u00e9, etc.) ?<\/em><\/p>\n\n\n\n

Dans une soci\u00e9t\u00e9 \u00e0 maisons l\u2019int\u00e9r\u00eat de la perp\u00e9tuation des corporations familiales d\u00e9passe ces m\u00eames institutions. Ces corps rev\u00eatent en r\u00e9alit\u00e9 un r\u00f4le fondamental dans l\u2019ordre constitutionnel et sociopolitique de la res publica, et sont l\u2019unit\u00e9 de base de la production et reproduction sociale et \u00e9conomique.<\/em><\/p>\n\n\n\n

Face aux risques continuels de crise et d\u2019extinction de la maison, tant les institutions souveraines et communautaires que le syst\u00e8me \u00e9conomique dans son ensemble, d\u00e9veloppent des dispositifs juridiques, sociaux et institutionnels destin\u00e9s \u00e0 soutenir la solvabilit\u00e9 \u00e9conomique et constitutionnelle des institutions familiales, en se chargeant et en se substituant, en derni\u00e8re instance, \u00e0 la maison lorsque celle-ci n\u2019est pas en mesure d\u2019assumer (ou cherche frauduleusement \u00e0 se soustraire) \u00e0 son devoir premier de garantir ad infinitum un \u201crepr\u00e9sentant\/administrateur\u201d capable de prendre en charge les obligations du corps. Si nous voulions utiliser une comparaison moderne, nous dirions que, quand l\u2019administrateur pro tempore de la corporation domestique vient \u00e0 manquer, les institutions communautaires, religieuses et souveraines d\u00e9veloppent des m\u00e9thodes de commissionnement, de protection et de tutelle confi\u00e9e \u00e0 une sorte de curateur de faillite, destin\u00e9es \u00e0 g\u00e9rer et honorer les obligations envers des tiers. L\u2019ordre social entier serait en r\u00e9alit\u00e9 min\u00e9 si la confiance dans la solvabilit\u00e9 des institutions familiales, comme noyau de la production et de la reproduction sociale, \u00e9tait affaiblie. Ces dispositifs de tutelle, en outre, ont toujours un double m\u00e9rite : d\u2019une part, ils repr\u00e9sentent des m\u00e9canismes fonctionnels de contr\u00f4le social et d\u2019intervention des entit\u00e9s sup\u00e9rieures (la\u00efques et eccl\u00e9siastiques) dans les dynamiques internes aux corps ; de l\u2019autre, ils offrent \u00e0 ces derniers de pr\u00e9cieux instruments pour revendiquer des droits et r\u00e9pondre aux risques de faillite.<\/em><\/p>\n\n\n\n

La journ\u00e9e d\u2019\u00e9tude se propose d\u2019analyser justement ces dispositifs de tutelle et les institutions pr\u00e9pos\u00e9es \u00e0 affronter le probl\u00e8me de la faillite de l\u2019institution domestique, en focalisant l\u2019attention sur le moment de la transmission interg\u00e9n\u00e9rationnelle des biens, droits et obligations. Elle se propose en particulier de concentrer l\u2019attention sur la gestion de ce que l\u2019on appelle les h\u00e9ritages jacents (les patrimoines qui restent temporairement sans propri\u00e9taire en attendant que l\u2019h\u00e9ritier l\u00e9gitime en revendique la possession) et les h\u00e9ritages ou biens vacants (les patrimoines rest\u00e9s sans propri\u00e9taire par l\u2019extinction des lign\u00e9es de succession). Les processus dont on a restitu\u00e9 plus haut les logiques de l\u2019articulation \u00e0 partir de terrains ib\u00e9riques et latins paraissent ne pas \u00eatre sp\u00e9cifiques \u00e0 ces seuls espaces g\u00e9o-historiques. Au contraire, l\u2019hypoth\u00e8se de base qui est soumise \u00e0 discussion est que diff\u00e9rentes soci\u00e9t\u00e9s, dans le temps et l\u2019espace, ont d\u00fb affronter un m\u00eame probl\u00e8me : garantir qu\u2019aucun patrimoine ne reste sans propri\u00e9taire afin d\u2019assurer l\u2019accomplissement des obligations r\u00e9ciproques et de prot\u00e9ger les relations sociales et \u00e9conomiques (par exemple \u00e0 travers le paiement des dettes et des cr\u00e9dits aussi bien s\u00e9culiers que spirituels, mat\u00e9riels que symboliques, ainsi que l\u2019ex\u00e9cution des obligations fiscales ou c\u00e9r\u00e9monielles, etc. ).<\/em><\/p>\n\n\n\n

Ainsi, il est propos\u00e9 de r\u00e9fl\u00e9chir autour de quelques th\u00e8mes g\u00e9n\u00e9raux propices \u00e0 g\u00e9n\u00e9rer une r\u00e9flexion comparative. Une s\u00e9rie (qui ne doit certainement pas \u00eatre exhaustive) de questions pourrait \u00eatre r\u00e9sum\u00e9e comme suit.<\/em><\/p>\n\n\n\n

En premier lieu, \u00e0 qui sont les biens qui restent sans h\u00e9ritiers, ceux qui dans la terminologie du droit romain sont d\u00e9finis comme les biens \u00ab vacants \u00bb ? Qui est, en d\u2019autres termes, l\u2019h\u00e9ritier en derni\u00e8re instance de tels biens ? Qui agit en tant qu\u2019ex\u00e9cuteur testamentaire des familles qui risquent l\u2019extinction ou qui s\u2019\u00e9teignent ? A travers quelles institutions ces personnes interviennent-elles, et comment sont administr\u00e9s les biens qui restent \u00e9galement temporairement \u00ab vacants \u00bb, comme par exemple justement dans le cas d\u2019un h\u00e9ritage jacent ? Quel r\u00f4le jouent les domaines coloniaux de la premi\u00e8re \u00e9poque moderne dans la cr\u00e9ation de nouvelles institutions et dans l\u2019\u00e9volution de celles d\u2019origine m\u00e9di\u00e9vale ?<\/em><\/p>\n\n\n\n

Dans un second temps, comme sont prot\u00e9g\u00e9s les droits des h\u00e9ritiers absents, ou incapables, pour maintenir les liens sociaux ? Quels institutions et instruments de tutelle sont mis en \u0153uvre par les entit\u00e9s sup\u00e9rieures pour prendre soin de ces droits et de ces patrimoines ? Comme sont identifi\u00e9s les h\u00e9ritiers l\u00e9gitimes et comment sont recueillies les informations les concernant ? De quels dispositifs et institutions les h\u00e9ritiers absents peuvent-ils user pour prot\u00e9ger leurs propres droits et biens pr\u00e9caires ? Comme sont prot\u00e9g\u00e9s, en outre, les droits des \u00ab personnes \u00bb qui \u00e0 cause de leur nature \u00ab immat\u00e9rielle \u00bb (les \u00e2mes des d\u00e9funts, les legs pieux, etc.) ont besoin de la nomination perp\u00e9tuelle d\u2019un curateur et d\u2019un administrateur \u00ab mat\u00e9riel \u00bb ?<\/em><\/p>\n\n\n\n

En troisi\u00e8me lieu, quelles sont les techniques adopt\u00e9es pour l\u00e9gitimer de telles appropriations ? Quel usage est fait des biens rest\u00e9s vacants quand ils sont attribu\u00e9s \u00e0 l\u2019entit\u00e9 souveraine ou \u00e0 la communaut\u00e9 ? Quel r\u00f4le jouent ces biens et ces pratiques dans la cr\u00e9ation et la perp\u00e9tuation des appartenances locales et supra-locales ?
